Public offer for sale of tickets to entertainment events held at the International Specialized Exhibition EXPO-2017 in Astana (Kazakhstan)
1. Terms and definitions
In the framework of this Offer, the following terms and definitions are used in the singular and plural forms as equivalent, unless otherwise can be inferred from the meaning of the term and/or definition, with the following meanings:
Agent: a person (persons)selling (booking) the tickets to the Event pursuant to an agreement with the Operator of the Agency Agreement (Commission Agreement, Services Agreement etc.).
Cancellation: cancellation of the Order and transfer of the Tickets ordered by the Buyer back to public sale.
Ticket: a unique document certifying the right of the Buyer to visit the Event at the specified time and date. The Ticket may be issued in the form of an Electronic Ticket (e-Ticket) and/or Ticket on paper. (Unless it is specifically indicated that some terms of this Offer cover only some form of the ticket, the provisions apply to all forms of tickets);
Exhibition: the International Specialized Exhibition EXPO – 2017 in Astana (Kazakhstan).
Services Agreement: the services agreement concluded (being concluded) between the Organizer and the Buyer on the terms and conditions of this Offer in connection with the Event, in accordance with which the Organizer provides services to the Buyer related to the organization and conduct of the Event.
Order: one or more Tickets to the Event ed by the Buyer and interlinked in the System under a single identification number.
Call center: the contact center of the Operator with the phone number: +7 717 272 71 09
Personal account: the section on the website provided to the Buyer after registering an account on the website.
Event: a performance event, including: theatrical performance, circus show, concert in a hall, club, outdoors, a sporting event, any other event, held in the framework of the Exhibition.
Place of concluding the Offer / Services Agreement: the city of Astana.
Ticket Face Value: the price of visiting the Event set by the Organizer for all Buyers or certain categories of Buyers as set by the Organizer and specified on the Website.
Operator: Limited Liability Company “Kassir Kazakhstan”.
Organizer: Joint Stock Company “National Company “Astana EXPO-2017”, which organizes the Events and provides Tickets to the respective Events for distribution to the Operator.
Offer: this Offer on the sale of tickets to the Events at the Exhibition.
Buyer: a physical or legal person, which addressed the Operator (the Agent) wishing to purchase a Ticket to an Event.
Visitor: a physical person having the right to visit the Exhibition in accordance with the Ticket.
Applicable Law: the Legislation of the Republic of Kazakhstan.
Website: the website at tickets.expo2017astana.com, administered by the Operator.
Transaction: actions of physical and legal persons aimed at establishing, changing or terminating the civil rights and duties.
System: a hardware and software complex (automated system) used by the Operator for the purposes of Ticket sales and ensuring such sales.
Point of Sales: official ticket offices, official website for sale of tickets, ticket centers of the Operator.
E-ticket: a document created and sent to the Buyer in electronic form and printed by the Buyer.
2. General provisions
2.1. This offer regulates the conditions and procedures for Ticket sales and contractual commitments (rights and obligations) arising in connection with this among the Operator, the Agent, the Buyer and the Organizer.
2.2. The Tickets is sold to the Buyer solely on the conditions of this Offer and only in case of its full and unconditional acceptance by the Buyer. Partial acceptance or acceptance on other conditions is not allowed. The Buyer’s use of the Operator’s services under the conditions of this Offer indicates the full acceptance of the terms of this Offer by the commission of the conclusive action.
2.3. In order to purchase Tickets from the Operator (Agent), individual entrepreneurs and legal entities, as well as their branches and representative offices carry out their payment as agreed with the Operator (Agent) by any means that are not prohibited by the law under the Transaction concluded between the Operator (Agent) and such legal entity, as well as branches, representative offices and individual entrepreneurs.
2.4. The Tickets are sold to the Buyer under conditions of this Offer exclusively for personal purposes not related to Buyer’s business activities. The Buyer accepts and agrees that he/she shall not be entitled to use the Tickets with the aim of promoting their goods (works, services) as well as goods (works, services) of a third party, as well as for the purpose of resale of the purchased Tickets by the Buyer to third parties regardless of the resale price.
2.5. The Tickets cannot be sold to the Buyer, if the Buyer does not fully accept the conditions of this Offer. The sold Tickets can be returned, and the refusal to perform the Services Agreement is not accepted on the grounds of disagreement of the Buyer with the terms of this Offer after the acceptance of its terms and conclusion of the Transaction. The refund for the sold Tickets is possible only in the manner and on the terms set forth in this Offer.
2.6. The conditions of this Offer remain fully effective and apply to the Buyers engaged in the purchase of the Tickets through the Website, Points of Sale and Agents of the Operator or other persons acting on its behalf, in which case, depending on the method of the Ticket sale, this Offer may set separate conditions for the sale.
2.7. In respect of certain categories of Buyers (pupils, students, pensioners etc.), identified by the Organizer, the Organizer may set another face value for the Tickets and/or a discounted face value of the Tickets upon presentation by such Buyers of the documents confirming their belonging to the respective category. The specified information, as well as the information on the timing of the Ticket sales and their categories (types) shall be communicated by the Organizer to the attention of the Buyers on the Website and at the Points of Sale.
3. Subject of the Offer
3.1. The subject of this Offer is:
3.1.1. providing to the Buyer of the services on booking and registering the sales of the Tickets to the Event;
3.1.2. conclusion of the Services Agreement with the Buyer on behalf of the Organizer.
3.2. The Party to the Services Agreement, which is responsible for the quality of the services under the Services Agreement specified in paragraph 3.1.2 of this Offer is the Operator. The Operator does not acquire rights and responsibilities and is not liable for the quality of the Services rendered under the Agreement specified in paragraph 3.1.2 of this Offer. The Operator’s liability is limited to the obligation related to the provision of the services specified in paragraph 3.1.1 of this Offer. The Organizer is responsible for fulfillment of all obligations, directly and/or indirectly associated with the organization of the Event, except for Operator’s obligations specified in paragraph 3.1.1 of this Offer.
3.3. The Operator is not liable for the actions (lack of actions) of the Organizer and/or other persons acting on behalf of the Organizer and/or on their own behalf, but only if instructed to act so by the Organizer, including in connection with the sales of Tickets by such persons, as well as for the organization, holding and content of the Event.
4. Acceptance procedure
4.1. The Buyer accepts and agrees that prior to acceptance as defined in this Offer, he/she read the terms of this Offer and other binding rules as specified in paragraph 14.1 of this Offer. The Buyer acknowledges and agrees that the provisions of this Offer and other regulations are fully understood.
4.2. The Buyer acknowledges and agrees that all the actions (lack of actions) of its representative (representatives) are committed with his/her knowledge, consent and in the interests of the Buyer. The Operator (Agent) cannot be held liable for these actions (lack of actions) of the representative (representatives) of the Buyer.
4.3. The acceptance is provided by the Buyer through the purchase of the Tickets on the Website or at the Point of Sale.
4.4. When purchasing the Tickets via the Website, the acceptance is provided by the Buyer through the successive performance of the following actions:
4.4.1. access to the Website and registration on the Website by providing the Buyer’s data. After providing the data, an automatic message will be generated and sent to the e-mail address specified by the Buyer with instructions on activating the Buyer’s account on the Website and on its use;
4.4.2. using the Buyer’s data for accessing the Website where the Buyer should access to his/her Personal account on the Website, then some specific day(s) for attending the Event and receive the e-Ticket. The Buyer accepts and agrees that he / she shall not be entitled to purchase more than 5 (Five) Tickets at a time.
4.4.3. The Buyer is entitled to purchase the Tickets mentioned in this paragraph only after the account registration on the Website.
4.5. When purchasing the Tickets at the Point of Sale, the Buyer’s acceptance is provided by the successive performance of the following actions:
4.5.1. contacting the Point of Sale;
4.5.2. ing the specific day(s) for attending the Event and purchase of the Ticket on paper. The Buyer accepts and agrees that he / she shall not be entitled to purchase more than 5 (Five) Tickets at a time.
4.6. The execution of the actions specified in paragraphs 4.4.1 and 4.4.2 or 4.5.1 and 4.5.2 of this Offer is deemed as full and unconditional acceptance by the Buyer of all the terms of this Offer without any exceptions and/or restrictions (of the acceptance) and is equivalent to the conclusion of the agreement in a simple written form in accordance with effective law. The acceptance of this Offer entails conclusion of the Services Agreement.
4.7. After the conclusion of the Agreement, the Buyer:
4.7.1. shall pay the cost of the Ticket in the manner specified in article 7 of this Offer;
4.7.2. shall receive the Ticket at the Point of Sale or at his/her e-mail address depending on the type and form of the acquired Ticket.
4.8. When ordering a Ticket in a manner other than contacting the Point of Sale, the non-performance by the Buyer of the terms of the Agreement relating to the payment of the Ticket face value within 48 (forty-eight) hours shall result in termination of the Services Agreement and Cancellation of the payment to be made by the Buyer in accordance with paragraph 4.4 of this Offer. When the Buyer contacts the Point of Sale, the payment is effected by the Buyer on the spot.
4.9. After the full payment for the e-Ticket, the Buyer should print out the e-Ticket, access to which is provided in the Personal Account on the Website and/or sent to the Buyer’s email, which is specified when ordering the Ticket. When printing out the e-Ticket, the Buyer should ensure proper printing quality of the e-Ticket. In the case of non-performance or improper performance of the obligations set forth in this paragraph, the Buyer is fully responsible for such actions (lack of actions), including the case of refusal by the Organizer to allow entrance at the venue of the Event. The Operator shall not be liable for any loss of the Buyer in case of violation of the terms of this paragraph, because the Operator is not a party to the Services Agreement.
4.10. When entering the venue of the Event, the Buyer must have the Ticket. In order to protect the rights and interests of the Buyer and to prevent the use of the Ticket by unauthorized persons, the Buyer is advised to carry an identity document. Without presenting the specified document, the entrance to the Exhibition may be disallowed.
4.11. The Buyer is solely responsible for the preservation and protection of the Ticket against being copied. If the Ticket is copied, the access to the Event will be ed on the Ticket that is presented first.
4.12. On behalf of the Organizer, the Operator sets the start and end dates of the Ticket sales for different days (periods) in the framework of the Event, different Ticket categories and different sales channels (Website, Points of Sale). The comprehensive information on the timing of the Ticket Sales, timing of their Sales depending on the category and/or form of the Ticket and depending on the Sale channels is provided on the Website, at the Points of Sale and can be presented to the attention of the Buyer when the Buyer calls the Call Center. The Buyer accepts and agrees that the information provided to the Buyer in accordance with this paragraph is complete and sufficient.
4.13. If the type of Tickets is separately specified on the Website, Points of Sale or when contacting the Call center for a particular day of the Event or in relation to a specific Ticket category, the Buyer can purchase only the Tickets of the specified type (e-Ticket, Ticket on paper).
4.14. When Buyer purchases the Tickets, not on the Website or at the Point of Sale, from persons acting as Agents of the Operator, the Buyer acquires the ticket at its Face Value set by the Organizer for all Buyers or for certain categories of Buyers determined by the Organizer and specified on the Website. Additional charges that may apply when the Buyer purchases the Ticket from these persons for the provision of services of booking, registration and sale of tickets shall not increase the Ticket face value. The Buyer on his/her own and in his/her interests determines the place and the person from whom they purchase the Tickets; the Operator and/or the Organizer are not liable for the choice made by the Buyer.
4.15. The date of Ticket Sales start through the Website and Points of Sales are determined by the Organizer and are specified on the Website.
5. Personal data treatment conditions
5.1. In accordance with the legislation of the Republic of Kazakhstan, regulating the relations with consumers, the Buyer acknowledges and agrees that the execution by the Buyer of the actions referred to in paragraphs 4.4 or 4.5 of this Offer represents the full and informed consent of the Buyer to provide their personal data to the Operator (Agent), as well as personal data of third parties communicated by the Buyer to the Operator (Agent) in the process of registering the Order, purchase of the Ticket, registration of the account on the Website, namely: surname, name, patronymic, contact phone number, country, city and contact email address.
5.2. The Buyer hereby acknowledges and agrees that the provision by the Buyer to the Operator (Agent) of his/her personal data specified in paragraph 5.1 of this Offer is done for the purpose of rendering to the Buyer of the services specified in paragraphs 3.1.1 and 3.1.2 of this Offer; the Buyer provides their consent to the Operator regarding the processing of the personal data provided when Ordering, purchasing the Ticket, registering an account on the Website, in connection with providing to the Buyer of the services described in this Offer, including with the purpose of provision to the Buyer of information and advertising messages in the manner and on the terms stipulated in the Public Offer regarding the receipt of informational and promotional emails, as posted on the Website. The Operator is entitled to store and use the personal data provided by the Buyer from the moment of provision by the Buyer of the consent to their provision (processing) and until the official end date of the Event.
5.3. Personal data shall be processed in accordance with the legislation of the Republic of Kazakhstan, regulating relationships with consumers and shall include collection, systematization, accumulation, storage, clarification (, change), sorting, using, depersonalization, blocking, or destruction. The Operator shall process the personal data with use of automation tools.
5.4. The Buyer hereby provides his/her full and informed consent to the Operator to the ing of rights to process the personal data referred to in paragraph 5.1 of this Offer in the manner specified in paragraph 5.3 of this Offer, by third parties for the purposes described in paragraph 5.2 of this Offer. At the request of Buyer, Operator shall provide to the Buyer information about the transfer of personal data in accordance with this paragraph to third parties.
5.5. The Buyer is entitled to exercise his/her rights established by the legislation of the Republic of Kazakhstan, regulating relations with customers, by sending appropriate requests (demands) to the Operator via a letter to the email address or by submitting such demand through the Contact Center or the Point of Sale.
6. Rights and Obligations of the Parties
6.1. The Buyer is entitled:
6.1.1. to inquire independently from open sources on the price of Tickets to the Event, their categories and types, as well as other services in connection with the Event, and make their own decision on the purchase of Tickets by full and unconditional acceptance of the terms of this Offer or refusal to purchase the Tickets from the Operator (Agent);
6.1.2. to receive information on rules of Tickets Sale, the available categories and forms of Tickets and other information regarding the Event, which is provided by the Operator in the framework of its competence, using Internet, a telephone call to the Operator (to the Operator’s contact center), and in other ways specified on the Website. The Operator is entitled to refuse to sell the Ticket to the Buyer in cases defined in this Offer, as well as valid provisions of the applicable law;
6.1.3. to choose the method of payment for the Ticket as specified in Article 7 of this Offer. The Buyer acknowledges and agrees that he / she is obliged to become pre-acquainted with the payment rules via one way or another;
6.1.4. to provide feedback about the work of the Operator at the addresses specified on the Website.
6.2. The Buyer is obliged:
6.2.1. to become acquainted with all the terms of this Offer and other binding rules set out in paragraph 14.1 of this Offer and accept them when purchasing the Ticket; the Buyer is also obliged to regularly visit the Website of the Operator;
6.2.2. to strictly follow the terms of this Offer and the Services Agreement, as well as the binding requirements of the Organizer.
6.2.3. to fully pay for the cost of a Ticket before receiving it. The unpaid Ticket is not subject to delivery (being sent) to the Buyer and the Order will be cancelled;
6.2.4. when the Ticket is purchased through the Website, to ensure the access to the Website and the s of used email services providing e-mail addresses; in particular, the Buyer undertakes to ensure the inclusion of the Website in the “white list” in his/her mail service to eliminate any possibility of undelivered messages from the Operator to the email address of the Buyer;
6.2.5. to read the recommended limitations set by the Organizer in terms of minor children access to the Event. The Buyer is fully responsible for such persons;
6.2.6. when ordering a Ticket, to check carefully all the information on the Ticket, which are essential for the Services Agreement, and in the case of errors made by the Buyer or the Operator (Agent), to promptly notify an employee of the Operator (Agent) about the errors. The Operator (Agent) is responsible for errors in the Ticket or for incorrectly ordered Ticket if the guilt is found with the employee (specialist) who helped to order the Ticket. The ticket has to be cancelled in case of a technical error, technical failure of other form of failure (partial mal) in the information system (its components) upon the issuance of a Ticket, in the information specified in this Ticket, occurring at no fault of the Operator. When the Ticket is cancelled by the Buyer for whom this ticket was issued, it is subject to refund against the Ticket face value. The cancelled Ticket with the corrected data is re-submitted for public sale, available for purchase by any Buyer. The information on the Ticket cancellation is communicated to the Buyer who purchased the Ticket. The Buyer, who acquired the cancelled Ticket before its submission to public sale, is entitled to demand the re-acquisition of the Ticket by notifying the Operator (Agent) or to request a refund in accordance with this paragraph.
6.3. The Operator has the right:
6.3.1. if the Buyer does not provide full and unconditional consent with the terms of the Offer, to refuse the Buyer to sign the Services Agreement and to provide the services stipulated in this Offer;
6.3.2. to require the Buyer to comply with the terms of this Offer and the Services Agreement;
6.3.3. to conduct planned and unplanned modification, replacement, reinstallation of the software on the Website, suspend the operation of such software upon detection of faults, errors and/or failures, and to perform preventative maintenance and prevent unauthorized access to the Website;
6.3.4. to demand the proper fulfillment of the duties to pay for the cost of the Ticket from the Buyer and to refuse to issue (to send) the Ticket in case of a breach of this condition;
6.3.5. To cancel the Buyer’s order in the case referred to in paragraph 4.8 of this Offer, and in the case provision by the Buyer in accordance with paragraph 4.4.1 or 4.4.2 of this Offer of incorrect and/or false information, as well as in the event of a breach by the Buyer of other terms of this Offer and the Services Agreement.
6.3.1. The agent is entitled:
(a) if the Buyer does not provide full and unconditional consent with the terms of the Offer, to refuse the Buyer to sign the Services Agreement and to provide the services stipulated in this Offer;
(b) to require the Buyer to comply with the terms of this Offer and the Services Agreement;
(c) to demand the proper fulfillment of the duties to pay for the cost of the Ticket from the Buyer and to refuse to issue (to send) the Ticket in case of a breach of this condition;
(d) To cancel the Buyer’s order in the case referred to in paragraph 4.8 and in the event of a breach by the Buyer of other terms of this Offer and the Services Agreement.
6.4. The Operator (Agent) is obliged:
6.4.1. provide the Buyer with complete and sufficient information in accordance with the requirements of the applicable law about the Event, the Organizer, the Operator and their services, as well as instructions on registration, payment, and receipt of the Ticket. The parties have agreed that the information posted on the Website, provided at the Points of Sales and/or reported by the Call center is exhaustive;
6.4.2. not to use the Buyer’s personal data for the purposes that are not relevant to the terms of this Offer and/or the Services Agreement.
7. Payment procedure
7.1. Ticket is not subject to delivery (sending) to the Buyer until the complete payment.
7.2. Buyer has the right to pay by any methods allowed by the Operator (Agent) and set forth in this Offer.
7.3. The exhaustive information on the payment methods is posted on Website, provided at the Points of Sale and/or communicated by the Call Center.
7.4. The Buyer has the right to make payments in the following ways:
7.4.1. by payment in cash in the currency of the Republic of Kazakhstan or any other currency allowed by the law at the Points of Sale on the territory of another state;
7.4.2. by a bank transfer:
22.214.171.124. by a bank (credit or debit) card (the cards of the following payment systems are accepted: Visa, MasterCard, and American Express);
126.96.36.199. by electronic money transfer.
7.5. The Buyer is deemed as having duly fulfilled the obligation to pay at the time of the money receipt at the bank account of the Operator (Agent) and/or at the Point of Sale.
7.6. The Buyer acknowledges and agrees that in the event of non-payment and/or incomplete payment, there will be consequences established by paragraphs 4.8 and 4.9 of this Offer.
7.7. In the case of fulfillment of the payment duties by using a bankcard, the Buyer is obliged to use the bankcard issued in his/her name or to have properly certified documents confirming the right to use the banking card issued in the name of another person. The Operator (Agent) is entitled to require from the Buyer to provide the original documents certifying the identity of the Buyer in case of payment using a bankcard. The Operator (Agent) reserves the right to refuse to accept the payment in case of the non-fulfilment by the Buyer of the requirements specified in this paragraph.
8. Procedure and conditions for refund
8.1. The Ticket is returned and refunded by the Operator (Agent), unless otherwise established in an agreement by the Operator (Agent) and the Organizer, which is indicated on the Website. The provisions of this article are fully applicable to cases of Tickets return, regardless of their place of purchase (on the Website or Point of Sale).
8.2. The Buyer may return only authentic Tickets purchased from the Operator (Agent) through the Website or at the Point of Sale. If the Ticket has physical damages (including but not limited to: holes, erasures, marks, corrections, writing made not by the Operator (Agent), absence of the “Control” voucher etc.), it is also accepted for return but only after verification of the authenticity of the Ticket. In any case, the Tickets may be returned if they are valid for entry to the Event on the date of the receipt by the Operator of the relevant application for refund. The Tickets for the past days of the Event may not be returned, and the refund applications received by the Organizer too late will not be considered due to the proper performance by the Organizer of its obligations under the Services Agreement mediated by such Tickets. In the same manner, the Operator and/or Organizer reserves the right to refuse to refund the Ticket to the Buyer in cases specified by certain provisions of the applicable law, particularly, in cases of abuse by Buyer of his/her rights or violation of the terms of this Offer when purchasing Tickets.
8.3. Subject to the requirements of paragraph 8.2. of this Offer and provided that the Ticket receipt and refund are effectuated by the Operator (Agent), the money can be returned to the Buyer only on the basis of the application submitted to the Operator (Agent) in a simple written form with the mandatory attachment of the original Ticket. The application form is provided by the Operator (Agent) on the Website and at the Points of Sale. The application shall be submitted personally or by a person acting under a notarized power of attorney at a Point of Sale of the Operator (Agent) at the address stated on the Website, with the presentation of the identity document, or by means of sending the documents to the email address of the Operator (email@example.com).
8.4. Subject to the provisions of paragraph 8.3 of this Offer, if the Ticket face value was paid by the Buyer by a bank transfer, the refund within the specified limits is carried out only by transferring the money to the Purchaser’s bank account stated in the application. If the Ticket face value was paid in cash, the Tickets are refundable at the Points of Sale specified on the Website.
8.5. The refund for the Tickets in accordance with paragraphs 8.1 to 8.4 of this Offer shall be made within ten (10) calendar days after the receipt of the Application by the Operator (or Agent) from the Buyer, written on the form specified in paragraph 8.3 of this Offer.
8.6. If the Ticket is refunded because of the cancellation, replacement or postponing of the Event (closing (full or partial) of the Event on the days for which the Ticket was purchased), as well as because of a unilateral refusal of the Buyer, the Buyer receives back the Ticket face value.
8.7. If the Ticket is refunded because of the unilateral refusal of the Buyer to use it, the Buyer will receive 100 (one hundred) percent of the Ticket face value in case of receipt of the Application for refund at least 48 (forty-eight) hours before the beginning of the Event.
8.8. If the Application for a refund is submitted in less than 48 (forty-eight) hours before the Event, the refund will not be possible. Exceptions are severe diseases of the Buyer or disease of the Buyer, which prevent him/her from visiting the Event, if confirmed with the relevant documents. In this case, the Application for Refund is accepted with the supporting documents from an appropriate authorized body;
8.9. Money for lost, spoiled or unused Tickets are not returned.
8.10. In case of cancellation (replacement, postponing) of the Event, and closing (full or partial) of the Event on the days for which the Purchaser purchased the Ticket, the refund shall be made in the manner prescribed in paragraphs 8.1 – 8.5 of this Offer at the place and time additionally specified on the Website and at Points of Sale. The Purchaser shall accept and agree that the official information indicating the cancellation, replacement or postponing of the Event (closing (full or partial) of the Event on certain days) is posted only on the Website and provided at the Points of Sale.
8.11. The Buyer acknowledges and agrees that the procedure and grounds for the Ticket refund and the person who is required to make such refund are communicated to the Buyer in full, known to him/her and well understood.
8.12. In the case of non-performance or improper performance of their obligations under the Offer and under the Services Agreement, the Parties shall bear responsibility in accordance with the legislation of the Republic of Kazakhstan, this Offer and the Services Agreement.
8.13. The Operator’s liability to the Buyer is limited by the responsibility of providing the Buyer with such services as booking, registration and sale of the Tickets.
8.14. The Buyer assumes all risks associated with his/her actions, potential errors and inaccuracies in the data supplied for registration of the Ticket.
8.15. The Operator shall not be liable for any physical or moral damage incurred by the Buyer because of erroneous understanding or misunderstanding of the information about the registration (payment) procedure of the Order, Ticket receipt, Event attendance, as well as the receipt and use of the services under the Services Agreement.
9. Limitation of liability and exemption from liability
9.1. The Parties are relieved from responsibility for non-performance or improper performance of their obligations under the Offer at the time of force majeure. Force majeure circumstances refer to extraordinary and inevitable circumstances that impede the fulfillment of the obligations by the Parties under this Offer. Such circumstances include natural phenomena; effects of a nuclear explosion, war, military invasion, hostilities, civil war, armed insurrection, popular unrest of any kind, riots, violent seizure or violent retention of power; epidemics, epizootics, adverse weather conditions, terrorist actions, strikes, seizures, confiscations, requisitions, nationalization. The party, which is affected by the above circumstances, should as soon as possible notify the other party about their occurrence. In this case, well-known events do not require any confirmation; as for other events, the relevant supporting documents are required, which may be, including, but not limited to, documents issued by competent authorities.
9.2. The Operator is liable to the Buyer for its services to the extent and on the grounds established by the legislation of the Republic of Kazakhstan.
9.3. The Operator assumes no liability for the cancellation, replacement or postponing of the Event, the possibility of access to the Event in case of violation by the Buyer of the terms of this Offer and/or Services Agreement, and binding rules established by the Organizer, as well as for any cases of non-performance and/or improper performance of the Services Agreement, due to the fact that the Operator is not a responsible person and not a party to the Transaction (agreement, contract) concluded between the Organizer and Buyer, in connection with the acquisition of the Ticket by the latter.
9.4. The Buyer is liable for non-performance and/or improper performance of the terms of this Offer and the Services Agreement in such cases, according to the procedures and on the conditions set forth in this Offer and the legislation of the Republic of Kazakhstan.
9.5. The Operator is not liable for the non-compliance of the services rendered (being rendered) by the Organizer with the expectations of the Buyer and/or his/her subjective uation. The advice and recommendations provided to the Buyer, inclusively by third parties, cannot be regarded as a guarantee and do not entail obligations for the Parties.
9.6. The Buyer acknowledges and agrees that the Operator is not liable for the quality, as well as other consumer and other properties (qualities) of the Event, because the Operator is not a party to the Services Agreement.
10. Rights relating to intellectual activity
10.1. The exclusive rights to intellectual property (results of intellectual activities), including, but not limited to: information, press releases, descriptions, graphics, pictures, artwork, slogans, software, audio and video material, trademarks, and service marks (hereinafter, the “Information”) available on the Website, the Ticket, in a press release, advertisement, or other information materials and any medium of information regardless of its form of presentation, belong to the Operator and Organizer, its affiliates and other related parties, sponsors, partners, representatives, other persons acting jointly or on behalf of the Agent and Organizer. The Buyer is not ed the rights for using the above-specified results of intellectual activity on any basis and in any form. The Operator does not guarantee and is not responsible for the quality of the Information, other than the information concerning the services provided directly by the Operator.
10.2. When posting links on Internet sites owned by third parties, subject to the provisions of paragraph 10.1 of this Offer, the Operator is not responsible for the content of such sites. The presence of links on the Website to Internet sites owned by third parties does not mean or imply that the Operator approves or recommends the user to view the content of such websites not owned by the Operator. The Buyer acknowledges and agrees that the Operator is not liable and cannot be held liable for the content of websites, as well as for the consequences of clicking on such links.
10.3. The Buyer agrees not to make audio, video recording and/or photography at the Event, except in the manner and on the terms set by the Organizer. In case of violation of the terms of this paragraph, the Buyer shall be liable in accordance with the legislation of the Republic of Kazakhstan.
11. Dispute resolution
11.1. In the event of any dispute or differences in connection with the performance and/or non-performance and/or improper performance of the provisions of this Offer, as well as the Services Agreement, the Parties shall make every effort to resolve them by following the procedure of filing complaints. The party claiming of the violation of its rights shall send the complaint to the other party in writing with attachment of properly certified documents supporting the outlined claims. The period for considering the complaints is 10 (ten) working days.
11.2. In case of failure to settle the disputes in the manner prescribed by paragraph 11.1 of this Offer within 60 (sixty) calendar days, such dispute shall be subject to consideration in court of Astana in accordance with the legislation of the Republic of Kazakhstan.
12. Entry into force the Offer and amendments to the terms of the Offer
12.1. This offer shall come into force upon its being posted on the Website and, in respect to the Ticket sale, shall be valid until the end of the Exhibition.
12.2. The Operator has the right to make changes and/or additions to this Offer at any time, but in any case such changes shall be brought to the attention of the public by posting them on the Website and at the Points of Sale at least 10 (ten) days before the changes and/or additions enter into force, in particular, such changes and/or additions being made at the instruction (request) of the Organizer. In case of the Buyer’s disagreement with the changes and/or amendments to the Offer, he/she must notify the Operator about this in writing before their entry into force and/or to stop using the Services. The Parties have agreed that the absence of such written notification from the Buyer is considered as his consent to the changes and/or additions to the Offer proposed by the Organizer. The Offer is considered changed and/or supplemented from the time specified in the Operator’s notification.
13. Amendment or termination of the Services Agreement
13.1. Changes in the terms of this Offer in respect of paragraph 12.2 of this Offer entail changes in the relevant provisions of the concluded Services Agreements in accordance with the terms of the mentioned paragraph.
13.2. The Buyer accepts and agrees that the termination of the Services Agreement in connection with the unilateral refusal by the Buyer entails the right of the Operator/Organizer to sell the Ticket on similar conditions as those for the Ticket previously purchased by the Buyer, to another person on the terms of this Offer, as well as on any other conditions set by the Operator/Organizer. The Buyer is not entitled, after the termination of the Services Agreement to use the Ticket, in particular, to present it for entering the Event, if this Ticket remained with the Buyer.
14. Final provisions
14.1. Unless it is set forth otherwise in this Offer, other rules also apply to the Parties, in particular, the binding rules for entrance, conduct, attendance at the Event, photo and/or video recording at the Event and other rules defined by the Organizer and posted on the Website. These rules are mandatory for enforcement and compliance. The Buyer’s acceptance of the terms of this Offer and conclusion by the Buyer of the Services Agreement mean his/her full and informed consent to the enforcement of these rules.
14.2. All other cases not provided in this Offer shall be governed by the provisions of the legislation of the Republic of Kazakhstan. The law applicable to the relations between the Parties to this Offer and under the Services Agreement is without exceptions the law of the Republic of Kazakhstan. If the Buyer is a citizen (national) of a foreign country, then superseding foreign laws are to be applied only in the cases and manner established by the legislation of the Republic of Kazakhstan.
